Congress vs. the Courts: Speaker Johnson’s Constitutional Warning
House Speaker Mike Johnson sent shockwaves through Washington this week, signaling that Congress may use its constitutional authority to defund or dismantle federal courts that have, in his words, “gone rogue.” His warning comes amid mounting legal attacks against President Donald J. Trump—attacks critics say are fueled by activist judges seeking to override the will of voters and paralyze the executive branch.
Legal Blitzkrieg: Trump Faces 137 Challenges in Under Three Months
Since his return to the White House in January 2025, President Trump has been slammed with an unprecedented 137 legal challenges—compared to just 65 during his entire first term. Many of these lawsuits are coming from coordinated left-wing legal networks, backed by sympathetic judges who have shown little hesitation in using nationwide injunctions to block policy decisions.
“This isn’t just judicial activism anymore,” said Josh Hammer, Senior Counsel for the Article III Project. “What we’re witnessing is a judicial insurrection—an open rebellion from the bench.”

Speaker Johnson Fires Back: “Congress Will Act”
In a pointed interview, Speaker Mike Johnson made it clear: Congress is no longer willing to stand by while activist judges launch legal warfare on the executive branch. He emphasized that the legislative branch has tools at its disposal—tools rarely talked about in mainstream political discourse.
“We do have authority over the federal courts,” Johnson said. “We can eliminate an entire district court. We have power over funding of the courts and all these other things. Desperate times call for desperate measures—and Congress is going to act.”
The statement was a direct shot across the bow, signaling that Republican leadership may be ready to use its constitutional powers to defend the presidency and restore balance among the branches of government.

Where’s the Supreme Court? Missing in Action
Thus far, the U.S. Supreme Court has been largely silent as activist judges issue injunction after injunction. Conservatives are growing increasingly impatient, questioning why the highest court in the land appears unwilling—or unable—to stop what they see as judicial sabotage.
Hammer warned that inaction now could embolden even more aggressive interference in the future: “If the Supreme Court fails to check this now, it sets a dangerous precedent. The judiciary was never meant to run the country.”
A Line in the Sand
Speaker Johnson’s message is clear: Congress has had enough. With control of the legislative purse strings and constitutional authority over the structure of federal courts, Johnson’s comments may mark the beginning of a new phase in the battle over separation of powers.
Whether Congress moves to rein in activist courts remains to be seen—but one thing is certain: the war over who governs America is no longer just political—it’s constitutional.
